These General Terms and Conditions ("Terms") govern the use of the AMR Solar website (www.amr-solar.co.za) and the services provided by AMR Solar (Pty) Ltd ("AMR Solar", "we", "us", or "our").

2.1. The AMR Solar website is intended for users to purchase products and services for their personal or commercial use.
2.2. Users must not use the website for any illegal, fraudulent, or unauthorized purposes.
2.3. Users must not infringe on the intellectual property rights of AMR Solar or any third party.
3. Products and Services
3.1. AMR Solar offers solar panels, installation, maintenance, and related services.
3.2. Products and services are subject to availability and may be withdrawn or modified at any time.
3.3. AMR Solar reserves the right to cancel or suspend any order or service.
4. Payment and Pricing
4.1. Payment methods accepted include credit cards and bank transfers.
4.2. Prices are inclusive of taxes and fees.
4.3. Payment is due on the date of invoice.
5. Delivery and Shipping
5.1. AMR Solar ships products within South Africa.
5.2. Delivery terms and conditions are as follows:
* Delivery will be made within 7-10 working days.
* Delivery is only available to physical addresses, not PO boxes.
6. Warranty and Support
6.1. The products sold by AMR Solar are sold without any warranty or guarantee.
6.2. The manufacturers of the products may offer their warranties or guarantees, which are separate from AMR Solar.
7. Cancellation and Refund Policy
7.1. Customers can cancel orders within 7 days of placement.
7.2. Refunds will be made within 30 days of cancellation.
7.3. Cancellations after 7 days may incur a restocking fee.
8. Intellectual Property
8.1. All intellectual property rights in the website and its content belong to AMR Solar.
8.2. Users must not reproduce, modify, or distribute the content without prior written consent.
9. Dispute Resolution
9.1. Disputes will be resolved through mediation, followed by arbitration if necessary.
9.2. The laws of South Africa will govern these Terms.
10. Governing Law
10.1. These Terms will be governed by and construed in accordance with the laws of South Africa.
11. Changes to Terms
11.1. AMR Solar reserves the right to modify these Terms at any time.

13. Limitation of Liability
13.1. AMR Solar will not be liable for any damages, including indirect or consequential damages.
14. Indemnity
14.1. Users agree to indemnify AMR Solar against any claims, damages, or expenses arising from their use of the website or services.
15. Force Majeure
15.1. AMR Solar will not be liable for any failure or delay in performance due to circumstances beyond its reasonable control.
16. Entire Agreement
16.1. These Terms constitute the entire agreement between the parties and supersede all prior agreements.
17. Waiver
17.1. Failure by AMR Solar to enforce any provision of these Terms will not be deemed a waiver of future enforcement.
18. Age Restriction
18.1. The website and services are only available to individuals who are 18 years or older. By using the website or services, you represent and warrant that you are 18 years or older.
19. Quotations
19.1. All quotes will remain valid for a period of 7 (Seven) days from the date of issue.
20. Payment Options & Terms
20.1. AMR Solar accepts the following payment methods:

20.2. Note: We do not accept Debit Card payments, Cheque Payments or Cash Deposits at this time.
21. Shipping Charges
21.1. Your total cost for the purchase of any product may include shipping and handling charges as reflected on the AMR Solar quote.
22. Delivery
22.1. Any delivery note or waybill (copy or original) signed by you or a person accepting delivery on your behalf and held by AMR Solar shall be sufficient proof that delivery was made to you.
23. Pricing
23.1. Price, specifications, and terms are subject to change; you are, therefore, requested to peruse the prices, specifications, and terms prior to placing any order.
23.2. The purchase price will be the current price as appearing on the AMR Solar website www.amr-solar.co.za.
24. Change of Orders
24.1. All orders and variations to orders are subject to these terms and conditions.
24.2. Only written orders and variations to orders will be accepted by AMR Solar.
24.3. Notwithstanding the above, AMR Solar may, at its sole discretion, elect to accept and act upon telephonic orders and any variations to orders.
24.4. AMR Solar, however, reserves the right to refuse delivery or collection of any order until placed in possession of a written order form.
25. Cancellation of Orders
25.1. Requests for cancellation of an order, prior to delivery, must be submitted in writing to info@amr-solar.co.za
25.2. No refunds will, however, be furnished on deposits or payments in the event of cancellation for specially ordered or manufactured goods.
25.3. Any order is subject to cancellation by AMR Solar should the goods ordered become unavailable due to any cause beyond AMR Solar's reasonable control.
26. Processing Times Policy
26.1. You can expect an order to be processed within approximately two to five business days, provided the items are in stock and the payment has been verified.
26.2. AMR Solar, therefore, cannot guarantee same-day shipping.
26.3. Customers should also note that no orders will be processed on weekends and official public holidays.
27. Back Orders
27.1. AMR Solar will notify you should there be any delay in obtaining/delivering any goods ordered.
27.2. The unavailable order will be placed on back order, and the remainder of the order placed will be shipped.
27.3. Please check our website for the back-ordered items' estimated time of arrival.
27.4. Please note that the dates reflected are estimates, and AMR Solar cannot guarantee the arrival dates.
27.5. Should the backorder, however, remain undelivered 30 (thirty) days from the date the order was placed you may cancel the agreement by giving AMR Solar 7 (seven) days written notice.
27.6. Any order is subject to cancellation by AMR Solar should the goods ordered become unavailable due to circumstances beyond AMR Solar's reasonable control.
28. Guarantees and Warranties
28.1. To the extent allowed by law, and notwithstanding any other provision of this agreement:
28.2. Any goods supplied by the company shall be subject to the manufacturing company’s warranty;
28.3. The only entitlement you shall have in respect of those goods shall be to require AMR Solar to apply such warranty against the manufacturer of those goods on your behalf.
28.4. All goods and items are to be returned to AMR Solar (Pty) Ltd - 2 Barker Street, Van RIebeeckstrand, Melkbosstrand at the customer's expense.
28.5. We do not offer any off-site warranty services.
28.6. PLEASE NOTE: We do not offer any warranties, nor will we enter into any claim regarding LA GEL or AGM batteries.
29. Returns
29.1. You may return goods in the following instances:
29.2. Within 7 (seven) days of the date of the receipt of the goods if the transaction falls within the scope of Section 44 of the Electronic Communications and Transmissions Act.
29.3. Within the implied warranty period if the product is defective according to the manufacturer's warranty;
29.4. Within 15 (fifteen) business days, if AMR Solar has wrongly supplied goods off a written order.
30. Returns Procedure
30.1. AMR Solar will not accept the return of any product without prior authorization and a confirmation return number issued by AMR Solar.
30.2. Customers agree to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment.
30.3. You are required to bear the cost of shipping and insurance required for the return of the goods to AMR Solar.
30.4. AMR Solar will not refund shipping charges unless an error in delivery was made by AMR Solar.
30.5. Customers agree that all returned products for credit, replacement, or refund will be 100% complete, in a resalable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided by the manufacturer.
30.6. There shall be a 25% return charge (as per supplier/manufacturer charge) for returns due to the order being incorrectly placed by the customer.
31. Repairs
31.1. No repairs will be handled by AMR Solar.
31.2. All manufacturer defaults will be handled directly by manufacturers or their appointed agents.
31.3. AMR Solar shall not be liable for any loss or damage of whatsoever nature which you may suffer as a result of any unforeseen costs and/or delayed repairs done by manufacturers.
31.4. AMR Solar will lodge any complaint and place you in contact with the manufacturer to process the repair work or replacement of any product that was purchased through AMR Solar.
31.5. All costs for shipping to the manufacturer will be at the client’s expense should the manufacturers not offer a call-out or free shipping policy to cover the expense.
32. Limitation of Liability
32.1. To the extent allowed by law, you agree that AMR Solar shall not be liable to you or any other person or entity whatsoever in respect of any loss or damage:
32.2. caused by or arising from any fact or circumstance beyond the reasonable control of AMR Solar;
32.3. which is consequential or incidental loss or damage; and/or
32.4. of whatever nature and howsoever arising from or in connection with the supply of goods.
33. Service Address and Notices
33.1. For all purposes under this agreement, including giving any notice, the payment of any amount, the service of any process, and for all other purposes arising from this agreement, you hereby choose the service address set out on the quotation for the order of goods.
34. Entire Agreement
34.1. These Terms constitute the entire agreement between the parties and supersede all prior agreements.

40. Indemnity

41. Age Restriction
41.1. The website and services are only available to individuals who are 18 years or older. By using the website or services, you represent and warrant that you are 18 years or older.
42. Severability

45. No Partnership
45.1. This agreement does not create a partnership or joint venture between the parties.
46. No Assignment
46.1. You may not assign or transfer your rights or obligations under this agreement without the prior written consent of AMR Solar.
47. Headings
47.1. The headings in this document are for convenience only and do not affect the interpretation of this agreement.
48. Governing Law
48.1. This agreement will be governed by and construed in accordance with the laws of South Africa.
49. Dispute Resolution
49.1. Disputes will be resolved through mediation, followed by arbitration if necessary.
49.2. The laws of South Africa will govern these Terms.
This document constitutes the entire Terms and Conditions of AMR Solar. By using the website or services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
